Our Proprietary Rights:
Service Content, Software and Trademarks:You are only authorized to use Make My Apparel service for the purpose of engaging in business transactions with Make My Apparel. The technology and software underlying the Make My Apparel Service or distributed in connection therewith are the property of Make My Apparel, our affiliates and our partners (the “Software”). You agree not to copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, or otherwise transfer any right in the Software.
The Make My Apparel Service may contain images, artwork, fonts and other content or features (“Service Content”) that are protected by intellectual property rights and laws. Except as expressly authorized by Make My Apparel, you agree not to modify, copy, frame, rent, lease, loan, sell, distribute or create derivative works based on the Make My Apparel Service or the Service Content, in whole or in part.. Any rights not expressly granted herein are reserved by Make My Apparel.
Make My Apparel name and logos are trademarks and service marks of Make My Apparel. Nothing in these Terms of Service or the Make My Apparel Service should be construed as granting any license or right to use any of Make My Apparel Trademarks displayed on the Make My Apparel Service, without our prior written permission in each instance. All goodwill generated from the use of Make My Apparel Trademarks will inure to Make My Apparel’s exclusive benefit.
User agreement :
You agree that- you are the owner of the information, trademarks and logos, and hold the copyrights of the same, which you share on your campaign through Make My Apparel. And otherwise, you agree to present Make My Apparel with evidence of valid permissions from the actual owner
You agree that any trademarks, logos, service marks and copyrights put to use in your campaign, are well in compliance with the restrictions and conditions imposed on the use of Licensed Rights.
You agree that upon acknowledgment of any claim which does not fall in line with Make My Apparel policy, Make My Apparel holds the sole authority and discretion of taking a decision, of disassociating itself from any ties with you or your campaign.
You agree to hold Make My Apparel unrelated towards any legal violation arising from or relating to the usage of Make My Apparel merchandise
You hereby, accept to abide by the policy/Terms of Services of Make My Apparel in whole.
By violating the user agreement, you hence, would be subject to disassociation with Make My Apparel and any other benefits linked to it.
Make My Apparel does not claim any ownership rights in the content you upload to our platform .
If any campaign violates or is alleged to violate our Acceptable Use Policy or any other part of these Terms of Service, in addition to any other remedies, you agree that Make My Apparel has the right to withhold any funds collected relating to the campaign or to control the defense or settlement of any claim or suit resulting from any such violation or alleged violation; and you agree to fully cooperate with Make My Apparel in such activities.
At Make My Apparel, we support our creators ( sellers ) and help them produce great custom products and a great experience for their buyers. In our efforts, we are also committed to protecting the rights of individuals and companies with respect to the content published on our platform
We, hereby, forbids the violation and infringement of third party intellectual property rights
We do not allow campaigns that infringe upon the rights of any third party, including in the description, title and url of a campaign, or the text and images featured in the created merchandise.
We have described some key rights below (trademark, copyright and right of publicity).
Trademark : A trademark is a word or symbol that indicates the “origin of goods”, meaning it allows consumers to identify the company that is ultimately responsible for a particular product. Creators are not allowed to use any third party trademarks on our platform unless they have permission. Make My Apparel conducts preventive reviews of all campaigns to help ensure third party rights are not violated.
Example of trademarks – using of cars images with company logo like bmw, audi etc, or sports franchise names or logo like Chennai super kings or any bollywood actors, actress pictures etc.
Copyright-Under copyright law, you are not entitled to use someone else’s work as a basis for your own unless you have permission. You have to originate your own works, creating them from scratch.
In case, you believe that the content/ merchandise of a particular campaign infringes into the intellectual property space of a third party please contact us. Upon presenting convincing evidence, we would provide your contact information to the particular campaign owner. If the campaign owner does not co-operate or contact you to resolve the issue – Make My Apparel holds the sole authority and discretion of taking a decision, of disassociating itself from the campaign.
If you believe that the Intellectual property rights have been compromised upon, in any of the campaigns, please reach us out at firstname.lastname@example.org
Please also help us with the following information
• Full contact information of the complainant
• Physical/electronic signature of the owner of Intellectual Property that has been infringed upon
• URL of the campaign in question
• Parts of the campaign (logo/trademark/content) that have been infringed upon
• Proof of ownership of Intellectual Property that has been infringed upon
• A statement that – you believe that items of the campaign, above mentioned, have been used without appropriate authority and such misuse of information legally amounts to infringement of intellectual property rights.
• A statement, under penalty of perjury, that the information attested by you, is complete and accurate and that you are the owner or have been authorized to act on behalf of the owner on the right that is allegedly infringed.
Limitation of Liability
MAKE MY APPAREL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY DAMAGES, OR DAMAGES FOR LOSS OF PROFITS INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF MAKE MY APPAREL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, RESULTING FROM: (I) THE USE OR THE INABILITY TO USE THE SERVICE; (II) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY MERCHANDISE, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; OR (IV) ANY OTHER MATTER RELATING TO THE SERVICE. IN NO EVENT WILL MAKE MY APPAREL’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID MAKE MY APPAREL OR MAKE MY APPAREL HAS PAID YOU IN THE LAST SIX (6) MONTHS, OR, IF GREATER. THE FOREGOING LIMITATIONS WILL APPLY TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW.
Make My Apparel, in its sole discretion, may suspend or terminate your account (or any part thereof) or use of its service and remove and discard any content within its platform, for any reason. Further, you agree that Make My Apparel will not be liable to you or any third party for any termination of your access to our service.
You are solely and fully responsible for payment of any income taxes applicable to the amounts you earn through the Make My Apparel.
Acceptable use policies
Hate Speech and Harassment-We do not allow campaigns that promote or glorify hatred toward people based on their age, race, ethnicity, national origin, gender, gender identity, sexual orientation, disability and religion, including people, organizations or symbols dedicated to hatred against these groups. Additionally, we will not allow campaigns including content that bullies, attacks or threatens specific individuals.
Nudity- We do not allow pornographic content in any campaign, including explicit or extreme representations of nudity or sexual activity.
Violence or Harm-We do not allow content that promotes or glorifies harm or violence to individuals or others, including campaigns in support of self-harm, incitement to violent acts, and praise or reverence of terrorist groups or figures. Raising awareness or showing support for victims of violence or human tragedy is allowed, provided you don’t violate any intellectual property rights.
Make My Apparel is a start up company offering an internet-based platform that allows campaign creators (“sellers”) to design certain products on our website named and promote the sale of those products to consumers (“buyers”) around India through individual campaigns.
Information We Collect
Personal Information -The Personal Information we collect depends on your activities on our platform.
a)If you register as a seller in our platform, we will collect your name and email address. If you register using a sign-in service or a social media platform such as Facebook or any other social sites, we will collect the information needed to authenticate your account and any other information the platform provides in that process. If you launch a successful campaign, we may collect your bank details depending upon the mode of payment you have chosen to.
b)If you are a buyer purchasing any product on our website, we will collect your name, email address, shipping address and phone number in order to contact you regarding the status your order. We collect payment through PayU money which is a payment gateway company
We collect only the information necessary for us to complete your order or to contact you regarding the status of your order. The information we collect includes your name, email address, shipping address, and billing address.
How We Use Your Information
In general, we use Personal Information to establish and administer your account, to fulfil your order and send you an order confirmation, to pay you any royalties earned and to respond to customer service requests.
If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you. You may choose to stop receiving our newsletter or marketing emails by following the unsubscribe instructions included in these emails, accessing the email preferences in your account settings
We will also share your Personal Information only with your permission. Otherwise, we do not rent, sell or share your Personal Information with third parties and specifically will not share your Personal Information for their direct marketing purposes without your consent.
Sellers We may share your buyers email address to the sellers so that the seller can promote their campaign to the buyer only if the buyer agrees to receive email for new campaigns.
Vendors and Service Providers. We may share information, including Personal Information, with third party vendors and service providers. For example, we provide Personal Information to companies that help us with our business activities such as third party vendor which does printing on products or shipping agencies to deliver products. We will use reasonable efforts to ensure those companies use your Personal Information only as necessary.
Fraud – We may share information with government agencies or other companies assisting us in fraud prevention or investigation. We may do so when permitted or required by law,or trying to protect against or prevent actual or potential fraud or unauthorized transactions or any fraud which has taken place.
We may use cookie and tracking technology for gathering information such as browser type, operating system, tracking the number of visitors to site, understanding how visitors use the site .Cookies can also help customize the site for visitors
The security of your Personal Information is important to us and we take reasonable steps to ensure that it is treated accordingly. However, we cannot ensure the security of any information provided to us. We do not accept liability for unintentional disclosure.
If we learn of a security system breach, we may attempt to notify you electronically or by sending an email to you.
